TERMS AND CONDITIONS
1.
You may only participate in a competition if you accept all of the following terms and conditions. This site is directed solely at people in the jurisdictions where participating is legal. Do not use this site if you are resident or located outside of the countries where participating is not legal. The following may not participate in a competition: the Promoter or its employees or agents or members of their immediate family and any other person directly connected with the administration or making of this competition.
2.
Proceeds from our prize draw competitions fund our growth and development. Your enjoyment and our reputation are of great importance to us. Please contact us immediately if you have any concerns, issues or suggestions.
3.
We will assign a set number of tickets that must be sold in each competition. The competition will close when all the tickets have been sold. Winners will be notified within 10 days of the competition closing. We will write to both the postal and email addresses you supply. You can of course check the status of a competition by visiting the web site.
4.
Winners must provide proof of identification and the card that was used to purchase the ticket and CarNutz.net will be entitled to take steps to verify these details before delivery of any prize.
5.
All cars are purchased for the winner from an official dealer. We place deposits with dealers before each competition is opened. We confirm the order, at the end of the 7-day period within which an election can be made for the cash alternative (see 8 below).
6.
Cars will be delivered to any address as directed by the winner. The Promoter will store the prize free of charge for 14 days after notifying the winner that the prize is available. If the winner has not accepted and taken delivery of the prize by then a charge of $200 per week will apply for storage for the next 30 days and increased rates after that. A prize will be forfeited and revert to the Promoter if the winner has not accepted delivery within 90 days after notification that it is available for delivery.
7.
We purchase a new car for the winner, against deposits we have already placed. Most prestigious cars are not always readily available and may take time to find and acquire.
8.
Within 7 days of the notification to the winner that he or she has won, he or she can elect to have the cash alternative. Also, in the unlikely event that it is no longer possible to source the car we will provide the cash alternative.
9.
These terms and matters relating to any competition are governed by Nevis law and these terms do not affect your statutory rights.
10.
You must be 18 years and over. By participating in a competition you warrant that you are 18 years of age or over, that you are resident in a country where participating in prize draw competitions is legal and that you are accessing the site from within boundaries where participating is legal, that you agree to the use of data relating to you in accordance with paragraphs 12 and 15 below and that you are not in breach of any relevant laws regarding the entering into by you of any competition on this website.
11.
The web site is intended for residents of the jurisdictions where participating is legal. You are responsible for ensuring that the local laws where you are resident or located allow you to participate. CarNutz.net and its management will not be held responsible for the breach of any laws if you are not a resident of or are located outside of the jurisdictions where participating in our prize draw competitions is legal.
12.
Data Protection: We use the personal data you provide to administer the competition and to notify you of other competitions / products. We may also have to use / disclose it for fraud prevention, legal or regulatory reasons. We will of course have to disclose some of your information to credit card processing and other suppliers. Should we ever transfer any part of our business to another company we would of course transfer your details to them. Some of the above transfers may be outside of the United States. If you do not wish us to notify you of other competitions/products please e-mail us at optout@CarNutz.net. We will remove you from our database as soon as practicable thereafter.
13.
You have the right to cancel within 7 days of entering a competition. Please email us at cancel@CarNutz.net if you wish to cancel.
14.
We reserve the right to cancel any competition, for any reason, before or after all or some of the entry tickets have been sold. If we do cancel a competition, we will return amounts paid to the participants of that competition.
15.
Should you accept the prize or the cash alternative then we reserve the right to use your name and home country for promotional purposes.
16.
No responsibility will be accepted for electronic, network, telecoms, systems, hardware or software faults, failures or omissions, or network availability, accessibility or congestion or failed, partial or garbled computer transmissions or the acts or omissions of any service provider or unauthorized human acts.
17.
With the exception of liability for death or personal injury caused by our negligence we shall not be liable for any loss. We make no representations or warranties with regard to the services offered nor as to the quality, suitability or availability of the goods offered as prizes.
18.
You will not be deemed entered into the competition until you receive a confirmation email from us. You may not correct your selected competition after you have entered your payment details.
19.

20.
An independent firm of chartered accountants is employed to carry out an assessment of the company's internal control procedures and to carry out sample check on prize draw competition transactions. They have access to our computer systems and premises.
21.
Although we make every effort to ensure that the CarNutz.net website is always available, we cannot guarantee that access will be continual and error free and will not be held responsible to you for periods when the website is unavailable.
22.
The design and content of the CarNutz.net website are wholly owned by CarNutz.net, Inc. and are protected by copyright. CarNutz.net, Inc. owns all intellectual property rights to all parts of the website.
